The
proclamation on December
10, 1996 of the THA Act
No. 40 1996, ushered in
new legislative
arrangements for the
governance of Tobago
under the unitary state
of Trinidad and Tobago.
Act No.
40 creates
a mechanism for the
devolution of the
governance of Tobago.
While the Central
Government retains
ultimate authority for
the governance of
Trinidad and Tobago, the
administration of Tobago
is a shared
responsibility of both
the Tobago House of
Assembly (THA) and the
Central Government.
The Ministry For
Tobago Affairs is the
legitimate body
accountable to the
Cabinet for Tobago
affairs, according to
Section 75(1) of the
Trinidad and Tobago
Constitution.

The Assembly,
under the jurisdiction of
the Cabinet, is
accountable for those
matters of governance as
listed in the Fifth
Schedule.
While the THA
has the responsibility
for formulating and
implementing policy
concerning activities on
the Fifth Schedule, The
Ministry For Tobago
Affairs has overall
responsibility to ensure
the provision of those
services listed under the
Sixth Schedule of Act
No. 40 and the Seventh Schedule
Ch. 27. No. 11.
The Ministry For
Tobago Affairs must also
ensure that mechanisms
are in place to ensure
and promote delivery of
those services listed
under the Sixth and
Seventh Schedules.
The Sixth and
Seventh Schedules are not
the responsibility of the
THA.

The Director of Public
Prosecutions.
The Chief Parliamentary
Counsel.
The Telecommunications
Division in respect of issuance
of licences.
The National Training
Board.
The Ministry responsible
for Industry and Commerce in
respect of the granting of
licences.
The Ministry responsible
for Agriculture in respect of the
granting of licences.
CARIRI.
The Bureau of Standards.
The National Lotteries
Board.
The Ministry responsible
for national Security in respect
of the issuance of police
certificates of good character,
forensic science, work permits
and residency application.
The Ministry of Health
in respect of laboratory tests
that are unable to be performed
in Tobago.
The Food and Drug
Division, Ministry of Health in
respect of inspection and
analysis of food and drugs.
The Lands and Surveyors
Department in respect of
compulsory acquisitions and
applications under the Real
Property Ordinance.
